EraFleet Terms of use together with the EraFleet Privacy Policy (“Terms”) forms a legally binding agreement between you and EraFleet that govern the use of this website and its services, creation and use of your account. By registering your account or by clicking to accept these Terms, you unconditionally accept it. If you do not agree to these Terms, then you may not use this website or/and EraFleet‘s services.
1. To create an account, you must be at least 18 years old unless otherwise required by the applicable laws. If you as an individual user are accepting the Terms on behalf of the company or other legal entity, you represent and warrant that you have the authority to do so.
2. In order to create your account, your email-address, password, and other personal data is required. The Privacy Policy governs the use of your personal data and other information. By creating your account you agree to provide complete information and to keep this information updated.
3. EraFleet does not assume any risk or responsibility and is unconditionally released from it if the user has not read these Terms in part or in full, even though he has been given such an opportunity.
4. For your own safety you agree to use strong password, which will be encrypted by using hashing technology. You must ensure that all access credentials and the password are only used by you and agree to protect them against misuse or unauthorized disclosure. The access to your account is for your use only and you agree not to sell, transfer, sublicense or make it otherwise available to any other company or person. You shall be solely liable for use of your account and shall notify EraFleet of any possible misuse and/or loss of your account‘s credentials.
5. You have a right to terminate this agreement at any time if you no longer wish to use EraFleet‘s services. After termination, you will no longer have access to your account or any other services provided by EraFleet.
6. EraFleet has a right to terminate this agreement with you and delete your account or restrict your access if: you have breached these Terms and/or there is a security threat to EraFleet website or services or/and there is misuse of the EraFleet‘s account.
7. EraFleet retain all intellectual property and other rights, title and interest in the EraFleet account and all the material provided through its platform.
8. You agree that EraFleet‘s services is provided under license and is not sold to you. In addition, you do not acquire any ownership in the service under this Agreement, or any other rights thereto other than to use the service and the materials in accordance with the license granted.
9. EraFleet‘s account, services and materials are provided on an “as is” and on an “as available” basis. To the maximum extent permitted by applicable mandatory law, neither EraFleet, its affiliates nor its suppliers warrant that EraFleet‘s materials and services will be uninterrupted, error or virus-free, accurate or complete. No warranty of any kind, either express or implied, including but not limited to warranties of title, non-infringement, merchantability, or fitness for a particular purpose, is made in relation to the availability, accuracy, reliability, information or content from or within EraFleet materials.
10. The use of your account, EraFleet‘s provided services and materials is at your own discretion and sole risk. EraFleet, its affiliates and suppliers are not liable for your lost profits, lost revenues, loss or recovery of data, or any indirect, special, consequential, incidental or punitive damages or expenses of any kind. In no event shall the total liability of EraFleet, regardless of the legal basis of the claim (e.g. tort, contract or otherwise), its affiliates and suppliers to you exceed the amount of 20 euro. The limitations of liability shall not apply to damages as a result of intent or deliberate recklessness by EraFleet.
11. Location or map data, directions or other features or content included in or accessible by EraFleet services may be inaccurate or incomplete and may depend on network availability. You need to rely on your own judgement and take into account the real-world conditions. You are responsible for your own conduct and must observe the local laws when using our services.
12. As the account holder You are responsible for clearly and regularly notifying the actual user (driver) of your device that their location may be tracked or discovered.
13. You agree that EraFleet will provide you with the notices, emails and messages about the services to you. You agree to keep your contact information shared with us up-to-date. You also understand and agree that the notices may be generated automatically.
14. Your access to and use of EraFleet‘s services is subject to your timely payment of the fees to EraFleet and depends on your chosen plan. However some services provided by EraFleet are free (for more information please check your account). Amounts not paid when due will accrue interest at a rate of 1.5% per month or the highest rate allowed by law. Note that all fees are nonrefundable.
15. Terms are exclusively governed by the laws of Lithuania without regard to its conflicts of law provisions. Any dispute between you and EraFleet related to the Terms, EraFleet‘s services, materials or the use of your account must be submitted to the court in Vilnius, Lithuania.
16. If a provision in the Terms is not enforceable, then the unenforceable part of the provision shall be removed, and the other provisions remain in full force and effect. You may not assign or transfer your rights and obligations under the Terms without our written consent.
17. EraFleet may assign its rights and obligations to its affiliates or to any company under common control with EraFleet. EraFleet may assign its rights and obligations to a third party in connection with a merger, acquisition, sale of assets or by operation of law.
18. We have a right to modify these Terms at any time without prior notice. You are responsible for regularly reviewing the Terms. If you do not agree to the modifications to the Terms, you may not continue using your Account.
